Federal Appeals Court Declares New Jersey's Semiautomatic Rifle and High-Capacity Magazine Bans Unconstitutional

A federal appeals court on Friday invalidated New Jersey's prohibition on certain semiautomatic rifles and magazines designed to hold more than 10 rounds of ammunition. This decision has been lauded by the National Rifle Association (NRA) as a "historic victory" in a legal challenge the organization has pursued since 2018.
In a comprehensive en banc ruling, the 3rd U.S. Circuit Court of Appeals, based in Philadelphia, determined that New Jersey's regulations concerning so-called assault firearms and high-capacity magazines are in violation of the Second Amendment.
The court's decision expanded upon an earlier lower court's finding, declaring the state's ban on "assault firearms" unconstitutional as it applies to the entire category of semiautomatic rifles, not just specific models like the AR-15. Furthermore, the court also struck down the state's general ban on semiautomatic rifles and its restrictions on magazines capable of holding more than 10 rounds.
Significant Victory for Gun Owners
The NRA promptly issued a statement celebrating the court's judgment, characterizing it as a major triumph for firearm owners across the country.
"Today marks a historic victory for the NRA, the Second Amendment, and law-abiding Americans," the organization declared. "The Third Circuit has struck down these unconstitutional so-called assault weapons bans and magazine bans in New Jersey, affirming what we've always known: the right to keep and bear arms, including commonly-owned rifles and standard-capacity magazines, is fundamental and cannot be infringed by politicians who prioritize control over constitutional freedoms.""This ruling protects the rights of millions of responsible gun owners in the Garden State and serves as another benchmark in our efforts to dismantle gun control across the country."
Legal Precedent and Historical Context
Writing for the majority opinion, U.S. Circuit Judge Arianna Freeman, an appointee of President Biden, explained that the Supreme Court's interpretations of the Second Amendment in cases such as District of Columbia v. Heller, New York State Rifle & Pistol Association v. Bruen, and subsequent related decisions, mandate that governments must demonstrate modern firearm restrictions align with America's established historical tradition of regulating firearms.
Applying this legal framework, the appeals court concluded that New Jersey failed to provide sufficient evidence to meet this burden.
The majority asserted that New Jersey's ban on semiautomatic rifles infringes upon the Second Amendment. Consequently, it reversed the district court's previous decision which had upheld the state's ban on magazines capable of holding more than 10 rounds.
The court's opinion noted that New Jersey initially enacted its "assault-firearms law" in 1990, following a school shooting incident in California.
According to the court, the governor at that time characterized the prohibited firearms as "guns capable of wholesale destruction" that were "designed to wipe out the greatest number of people in the shortest possible time."
Despite these past justifications, the majority ultimately determined that both semiautomatic rifles and magazines holding over 10 rounds are protected under the Second Amendment, and that New Jersey failed to prove its restrictions were consistent with the nation's historical approach to firearm regulation.
However, several judges issued dissenting opinions. They contended that the banned firearms represent unusually dangerous, military-style weaponry that states have historically possessed the authority to regulate. These dissenting judges also argued that the majority's decision contradicts rulings from every other federal appeals court that has previously upheld similar state restrictions.
